1. Age and Eligibility Requirements

• All renters must be at least 25 years of age.
• A valid driver’s license is required for the driver and any person towing the RV.

2. Insurance and Towing Requirements

• Renter must submit proof of insurance for the towing vehicle.
• If towing vehicle is rented, a copy of the lease is required.
• Tow vehicle must have a brake controller and all lighting systems functioning properly.

3. RV Operations Training

• All renters must complete hands-on training (approx. 45 minutes) before departure.

4. No Smoking Policy

• Absolutely no smoking inside the RV. Violation will forfeit security deposit.

5. Pet Policy

• Non-refundable pet fee: $90 per pet. Not all units are pet-friendly.
• Failure to notify about pets at time of booking will result in loss of security deposit.

6. Security Deposit and Damage Policy

• Security deposit ranges from $500 to $1500 depending on RV type and rental terms.
• Renter is responsible for any damage exceeding the deposit amount.
• Loss of equipment will incur item replacement cost plus $50 handling fee.
• Damage resulting in downtime will be billed for lost rental days.

7. Cancellation Policy

• 30+ days prior: 100% refund or free reschedule.
• 14–29 days: 50% refund or free reschedule.
• <14 days: No refund. $100 reschedule fee applies.

8. Safety Rules and Responsibilities

• Do not exceed 60 mph while towing or driving.
• Check tire pressure and walk around RV during stops.
• Awning must be retracted during rain, wind, at night, or when leaving site.
• Winter use requires renter to properly winterize or pay for damages.
• Late returns: $50/hour. Abandonment: $10/mile retrieval fee.
• No refunds for early returns or dry camping issues.
• Overflowing tanks or failure to dump are renter’s responsibility.

9. Complementary Services

• Third-party services are provided by Gira Group LLC.
• All liability remains with the renter regarding use of additional amenities.

10. RV Availability

• In case of unavailability, a similar RV will be provided if possible.

11. Motorhome Usage

• Includes 100 miles/day and 5 generator hours/day. Extra use billed accordingly.

12. Waiver and Release of Liability

By signing this rental agreement, the Renter acknowledges and agrees as follows:

1. Assumption of Risk: I voluntarily assume full responsibility for all risks of injury, illness, death, or property damage related to the rental, operation, and use of the RV and any included or optional equipment (including, but not limited to: bikes, fire pits, beach gear, and generator).

2. Release of Liability: I hereby fully and forever release, waive, and discharge RV Rentals Loma del Sol LLC and its owners, employees, contractors, affiliates (including Gira Group LLC), and agents from any and all claims, demands, damages, liabilities, or causes of action, whether known or unknown, arising out of or related to any loss, injury, or damage that may occur during the rental period, even if arising from the negligence of the company or its affiliates.

3. Indemnification: I agree to indemnify, defend, and hold harmless RV Rentals Loma del Sol LLC and Gira Group LLC from any claim, demand, or action made by a third party in connection with my use of the RV or any included or optional equipment.

4. Responsibility of Use: I certify that I have received adequate instruction for the safe operation of the RV and that I am solely responsible for any misuse or failure to follow instructions, as well as for ensuring the RV is used only by authorized drivers.

5. No Refunds Due to Weather or Events: I understand that my rental fee is non-refundable in the event of inclement weather, early return, or other conditions outside the control of RV Rentals Loma del Sol LLC.

6. Severability Clause: If any part of this waiver is deemed invalid by a court, the remaining provisions shall remain in full force and effect.

By signing below, I confirm that I have read, understood, and voluntarily agree to this Waiver and Release of Liability.
